GENERAL TERMS AND CONDITIONS OF F&B AFFAIRS AG
1. SUBJECT MATTER AND SCOPE
1.1.
These general terms and conditions (GTC) regulate the use of the website http://www.fbaffairs.ch or https://east-java-co-switzerland.myshopify.com and the legal relationship between F&B AFFAIRS AG (hereinafter: F&B Affairs). Any provisions of the customer that contradict these terms and conditions are hereby expressly excluded.
1.2.
The acceptance of these terms and conditions takes place by using the services offered by F&B Affairs. By using the services of F&B Affairs, the customer accepts the following conditions unchanged and in full. However, when using individual services of F&B Affairs, the customer can be asked to repeat his consent to the terms and conditions by clicking on a corresponding confirmation field.
1.3.
The terms and conditions can be called up, printed out or saved locally at any time on the website under “terms and conditions”.
2. Offer
2.1.
In the F&B Affairs webshop, users of the website (customers) are offered various goods for sale. The specific offer from F&B Affairs can be seen in the web shop.
2.2.
The F&B Affairs offer listed in the webshop is non-binding. F&B Affairs can change the range of services and prices at any time or stop the provision of services. The offers are only valid as long as they can be seen on the website.
3. Conclusion of the contract
3.1.
The offers advertised on the website are merely an invitation to the customer to submit an offer. By submitting his online order (and the associated simultaneous acceptance of these terms and conditions), the customer submits a legally binding offer to conclude a contract. The customer is obliged to provide all information required during the ordering process completely and correctly.
3.2.
The contract is concluded when the customer receives an order confirmation from F&B Affairs. The order confirmation is sent by email to the email address provided by the customer. Confirmed orders can no longer be canceled or changed by the customer.
4. Minimum age
The minimum age for ordering alcoholic beverages is 18 years. By placing the order, the customer confirms that he is at least 18 years old.
5. Prices and delivery costs
5.1.
All prices are given in Swiss Francs (CHF). VAT is included in the prices quoted. Any payment fees will be charged additionally. We reserve the right to make changes to the prices and conditions stated on the website, with the day on which the order is placed as the key date.
5.2.
The shipping and delivery costs are to be paid by the customer. The following costs are charged for postage:
Shipments within Switzerland and the Principality of Lichtenstein
The shipping fee is 6.50 CHF for consignments with economy shipping, for shipping with priority we charge 8.40 CHF. The shipping fee includes the statutory value added tax
From an order value of CHF 50.00 per order, we deliver free of charge.
Shipments within the EU
The shipping fee is 29.50 CHF. The shipping fee includes the statutory value added tax.
From an order value of CHF 250.00 per order, we deliver free of charge.
5.3.
A discount accumulation is excluded. We reserve the right to change delivery costs.
6. Payment, delivery and delivery area
6.1.
Payment is made either by debiting the credit card specified during the ordering process or by PayPal.
After payment has been made, we will deliver the goods to the customer by post to the postal address specified by the customer. During the ordering process, the customer can choose whether he wants delivery by normal post or by registered mail. Deliveries are made exclusively to Switzerland, the Principality of Lichtenstein and the EU.
8. Returns, Refunds and Exchanges; Complaints
8.1.
Subject to defective deliveries, the goods cannot be exchanged or returned. The customer must check the goods immediately upon receipt of the delivery. Complaints regarding damage or incorrect delivery must be sent by email to info@fbaffairs.ch within three calendar days, with photos of the defective goods attached. Otherwise the delivery is considered accepted. Damaged goods or incorrectly delivered goods will be replaced free of charge.
9. Disclaimer of Liability
F&B Affairs is only liable to the customer in the event of intentional or grossly negligent contractual or non-contractual damage. The corresponding liability is limited to a maximum amount of CHF 1,000.00. Proof of fault is incumbent on the customer. Any further liability is excluded.
10. Data protection
The customer's personal data transmitted to F&B Affairs (customer data) are processed in accordance with Swiss data protection law. F&B Affairs treats customer data as strictly confidential and exclusively for the purpose of fulfilling the contractual relationship. The customer data will not be passed on to third parties. In addition, the data protection declaration of F&B Affairs applies. This is available on the F&B Affairs website.
11. Changes and additions to these terms and conditions
F&B Affairs expressly reserves the right to adapt the terms and conditions at any time, for example to implement legal requirements or to take functional changes into account. The changes will be made available on the website under the heading “Terms and Conditions” and will take effect immediately when they are activated. Customers who do not agree to the changed terms and conditions can no longer use the services of F&B Affairs.
12. Legal validity of the terms and conditions
Should a provision or individual formulations of these terms and conditions be or become ineffective or void, this shall not affect the validity of the remaining provisions. In the event that a provision is invalid or null and void, it must be replaced by an effective provision that comes as close as possible to the economic purpose of the ineffective provision. The same applies mutatis mutandis in the event that these terms and conditions should contain a loophole.
13. Applicable law / place of jurisdiction
13.1.
Swiss law applies exclusively to these terms and conditions and any disputes arising from or in connection with the relationship between F&B Affairs and the customer. The provisions of international private law and the UN Sales Convention (CISG) are explicitly excluded.
13.2.
The ordinary courts of Zurich have exclusive jurisdiction for all disputes arising from or in connection with these terms and conditions, the legal relationships under them and the contracts concluded via the website. However, F&B Affairs is also authorized to assert its rights at the customer's domicile or before any other competent authority in the absence of a jurisdiction agreement.
